The Consumer will be able to check a box confirming acceptance of the general terms and conditions. GHR reserves the right to modify these general terms and conditions without prior notice. Upon confirmation of the booking or order, the Consumer will receive a copy of the general terms and conditions.   <\/p><p>By placing a booking or order, the Consumer represents and warrants that he is of legal age to be bound by these terms and conditions and that he is at least 18 years old. The Consumer will be able to check a box confirming that he is at least 18 years old before the order can be placed. In case the Consumer is not of legal age to book or purchase Services on the Website, the booking or purchase must be made by the parent or a legal guardian. All bookings or orders made by a minor will be refused.   <\/p><p><strong>ARTICLE 3 OFFERINGS &#8211; SERVICES<\/strong><\/p><p>Among other things, GHR offers the following goods and services through the Website:<\/p><ul><li><strong>Riding Lessons and Outdoor Rides <\/strong>&#8211; Riding lessons can be booked through the online calendar on the Website. After selecting an available date and time, the Consumer must confirm the booking and pay via the available payment methods. <\/li><li><strong>Group activities <\/strong>&#8211; Through the contact form on the website, children&#8217;s parties, birthday parties, etc. can be requested. Preferences regarding activities and food are optional and should be discussed in advance with GHR. Based on this information, an indication of the price will follow.  <\/li><li><strong>Contests and Events <\/strong>&#8211; Registrations and purchase of tickets for contests and events can be purchased on the Website. After selection and payment, the Consumer will receive a confirmation email. <\/li><li><strong>Stable rentals <\/strong>&#8211; GHR offers stable rentals for horses and ponies. Consumers can request information and indicate preferences through the contact form on the Website. Based on this information, a no-obligation price indication follows.  <\/li><\/ul><p><strong>ARTICLE 4 &#8211; BOOKING AND CONFIRMATION<\/strong><\/p><p>A booking or order can be placed by selecting the desired service, filling in contact and billing information, indicating the payment method and confirming agreement to the terms and conditions and minimum age. The last step is a summary of the booked service and prices where the booking is completed by clicking on the &#8220;pay now&#8221; button. By clicking this button, the Consumer enters into a binding agreement with GHR.  <\/p><p>The Consumer is then informed with a confirmation of the booking or purchase. The booking is considered closed as soon as the order has been placed and GHR has received payment. <\/p><p><strong>ARTICLE 5 &#8211; CANCELLATION AND MODIFICATION OF BOOKINGS<\/strong><\/p><p>5.1. If classes, group events, or other booked Services are cancelled by GHR due to a competition, event, or other circumstances on GHR&#8217;s part, GHR will notify the Consumer in a timely manner via email or SMS, depending on the means of communication chosen by the Consumer. The Consumer will then receive a full refund of the amount paid, unless the cancellation by GHR is due to an error, negligence or shortcoming on the part of the Consumer. In that case, GHR retains the right to withhold the amount paid.  <\/p><p>5.2. If the Consumer cancels a class, group event or other booked Services on his\/her own, for whatever reason and regardless of the time of cancellation, there is no refund. The amount paid remains due in full to GHR. This also applies if the Consumer does not appear on the agreed upon date and time (&#8220;no-show&#8221;).  <\/p><p>5.3. Lessons, events or other services booked will generally continue regardless of weather conditions. GHR reserves the right, at its sole discretion and judgment, to determine whether weather conditions or other circumstances (including health and safety of horses or riders) warrant modification or rescheduling of the booked service. <\/p><p>In such cases, GHR may, in its sole discretion, decide to:<\/p><ul><li>Modifying the class or event (for example, riding indoors instead of outdoors, adjusting the program or other measures).<\/li><li>Reschedule the class or event to another date and\/or time that GHR will notify.<\/li><\/ul><p>Any such adjustment, modification or relocation by GHR shall in no way fall under the term &#8220;cancellation&#8221; as referred to in Article 5.1 and shall not entitle Customer to any refund, compensation or damages. The Consumer acknowledges that GHR has the decision-making right to determine the manner in which the booked Service is performed or moved. In the exceptional case when an outdoor ride is changed to an indoor lesson due to weather conditions or other unforeseen circumstances, the Consumer retains the right to cancel the booking in a timely manner and receive a refund.  <\/p><p><strong>ARTICLE 6 &#8211; RIGHT OF WITHDRAWAL<\/strong><\/p><p>6.1. Exclusion of withdrawal rights for Services and reservations<\/p><p>The right of withdrawal does not apply to reservations of horseback riding lessons, events, group activities, competitions in accordance with Article VI.53, 12\u00b0 of the Economic Code.<\/p><p>6.2. Consequences of revocation<\/p><p>Upon withdrawal from the agreement, the Consumer will receive all payments made by the Consumer up to that point. The refund will be made no later than fourteen (14) days after the Consumer&#8217;s notification to withdraw from the contract. The refund will be made by the same means of payment with which the Consumer made the original transaction, unless the Consumer has expressly agreed otherwise. In any case, no fee will be charged for such refund.   <\/p><p>6.3. Model withdrawal form<\/p><p>(Complete and return this form only if the Consumer wishes to revoke the contract)<\/p><p><em>&#8220;To Gipsy Horses Ranch, at 2260 Westerlo, Mollemansstraat 14, Box C or by e-mail. <\/em><a href=\"mailto:info@gipsyhorsesranch.be\"><em>info@gipsyhorsesranch.be<\/em><\/a><em>;<\/em><\/p><p><em>I\/We (*) hereby inform(*) you that I\/We (*) revoke(*) our agreement regarding the purchase of the following service(s) (*)<\/em><\/p><ul><li><em>Ordered on (*)\/Received on (*)<\/em><\/li><li><em>Name(s) of consumer(s)<\/em><\/li><li><em>Consumer(s) address<\/em><\/li><li><em>Signature of consumer(s) (only if this form is submitted on paper)<\/em><\/li><li><em>Date<\/em><\/li><\/ul><p><em>(*) Delete what does not apply&#8221;<\/em><\/p><p><strong>ARTICLE 7 &#8211; PRICE AND PAYMENT<\/strong><\/p><p>7.1. Prices include all taxes, VAT, duties and Services. GHR reserves the right to charge additional shipping or administrative costs on top of the total amount of the purchase. These charges will be listed in the order summary.  <\/p><p>7.2. GHR accepts payments through the payment methods listed on the Website. To ensure safe online payment and the security of personal data, transaction data is transmitted over the Internet in encrypted form using SSL technology. A secure SSL connection is recognized by the &#8220;lock&#8221; in the lower status bar of the Consumer&#8217;s browser.  <\/p><p><strong>ARTICLE 8 &#8211; PERFORMANCE OF SERVICES.<\/strong><\/p><p>8.1. Horseback riding lessons\/outdoor rides and group events<\/p><p>Riding lessons\/outdoor rides and group events will take place on the date and time as confirmed in the booking confirmation. The Consumer must arrive on time. In case of late arrival (more than 5 minutes after the agreed time), the duration of the lesson or event may be shortened without right to compensation or refund. GHR reserves the right to refuse the lesson or event in case of serious delay without refund.   <\/p><p>8.2. Contests and events<\/p><p>For competitions and events, after payment, the Consumer will receive a confirmation with the relevant information about date, time and location.<\/p><p>8.3. Stable rental<\/p><p>For barn rentals, GHR contacts the Consumer upon receipt of the contact form. The conditions for stable rental, including prices and payment terms, are agreed upon separately between GHR and the Consumer. <\/p><p><strong>ARTICLE 9 &#8211; LIABILITY<\/strong><\/p><p>9.1. The Consumer acknowledges and agrees that the use of this Website is at his\/her own responsibility. This means that GHR cannot be held liable for the accuracy, usability and security of the content on the Website. GHR is also not responsible for the unavailability of the Website due to a technical malfunction or for any damage the Consumer may suffer.  <\/p><p>9.2. GHR can never be held liable for indirect damage, such as but not limited to, increase in costs, disruption of planning, loss of capital, &#8230; . GHR can only be held liable for proven damage as a result of intent, gross negligence or, except in cases of force majeure, the non-execution of its main commitments. GHR&#8217;s liability in such cases is limited to the amount of the service booked.  <\/p><p>9.3. The Consumer acknowledges that horseback riding and activities with horses involve inherent risks, including but not limited to falling, kicking, biting, unpredictable horse behavior and other accidents that may result in serious injury or death. By booking and participating in a lesson or event, the Consumer accepts these risks and the Consumer fully indemnifies GHR, its employees, volunteers and representatives from any liability for accidents, injuries, property damage or death occurring during or in connection with the performance of the Services, except in the case of willful misconduct or gross negligence on the part of GHR. <\/p><p>9.4. The Consumer is responsible for obtaining and maintaining appropriate insurance to cover any damage, injury or accidents that may occur while participating in riding lessons, events or other activities. GHR cannot be held liable for the lack of insurance on the part of the Consumer or for damages not covered by the Consumer&#8217;s insurance. <\/p><p><strong>ARTICLE 10 &#8211; FORCE MAJEURE<\/strong><\/p><p>In case of force majeure or imprevention, GHR is not obliged to fulfill its obligations. In such case, GHR may suspend its obligations for the duration of the force majeure, or permanently terminate the agreement. <\/p><p>Force majeure is the situation in which GHR&#8217;s execution of the agreement is prevented in whole or in part, temporarily or not, by circumstances beyond GHR&#8217;s reasonable control. This includes, but is not limited to: war, embargo, epidemic, pandemic, strikes, fire, energy failure, unavailability of (telecommunications) network or connection, unavailability of the Website at any time, illness or injury to horses, other impediments or hindrances, government restrictions or any other cause beyond the control of the affected party. <\/p><p>Imprevision is any change of circumstances, beyond the reasonable control of GHR, that seriously interferes with the performance of Services and\/or gives rise to disproportionate damage to its interests. No unforeseeable, unaccountable and\/or unavoidable character need be or proven in the case of force majeure or imprevision. GHR will notify the Consumer of the force majeure or imprevention within a reasonable time. In the event of imprevision, GHR has the right to require the Consumer to negotiate, in good faith, alternative equitable clauses that remedy the imprevision.   <\/p><p><strong>ARTICLE 11 &#8211; INTELLECTUAL PROPERTY<\/strong><\/p><p>GHR retains all intellectual property rights and derivative rights to its Website, logos, names, texts and photographs and in general all GHR communications protected by intellectual property rights. Consumers are not permitted to duplicate, reproduce, disclose or use in any way GHR&#8217;s intellectual property rights, in whatever form, without its prior written consent, itself or with the help of third parties. This applies equally to intellectual property of third parties published by GHR for which rights of use were granted to GHR by third parties.  <\/p><p><strong>ARTICLE 12 &#8211; PRIVACY AND DATA PROTECTION<\/strong><\/p><p>GHR processes personal data in accordance with applicable privacy legislation, including the General Data Protection Regulation (GDPR). For more information on the processing of personal data, GHR refers to the privacy statement as available on the Website. <\/p><p><strong>ARTICLE 13 &#8211; RULES OF CONDUCT AND SAFETY REGULATIONS<\/strong><\/p><p>13.1. The Consumer is obliged to comply with all safety regulations and instructions issued by GHR and its personnel. Failure to follow these instructions may result in exclusion from participation without the right to a refund. The Consumer must wear appropriate clothing and footwear. Wearing a safety helmet is strongly recommended during all horseback riding activities.   <\/p><p>Consumers under the influence of alcohol, drugs or medication that affect driving ability will be excluded from participation without the right to a refund.<\/p><p>13.2. The Consumer certifies that he\/she is medically fit to participate in horseback riding activities and has no medical conditions that could endanger the safety of himself\/herself, others or animals. GHR reserves the right to refuse participation if it deems that the Consumer&#8217;s medical condition poses a risk, with no right to a refund. <\/p><p><strong>ARTICLE 14 &#8211; GENERAL PROVISIONS<\/strong><\/p><p>14.1. These general terms and conditions constitute the entire agreement between GHR and Consumer and supersede all previous agreements, understandings or arrangements. The invalidity, illegality or unenforceability of one or more provisions of this Agreement does not affect the validity and enforceability of the remaining provisions. <\/p><p>14.2. If the Consumer has complaints about GHR&#8217;s Services, the Consumer can <a href=\"mailto:info@gipsyhorsesranch.be\">send them by e-mail to info@gipsyhorsesranch.be.<\/a> GHR will do its utmost to handle the complaint as soon as possible and within five (5) working days. <\/p><p>14.3. All legal relationships between GHR and Consumer and all disputes or claims relating to them are governed exclusively by Belgian law. Disputes concerning these legal relationships fall within the exclusive jurisdiction of the Belgian courts in the jurisdiction where GHR has its registered office. <\/p><p>14.4. In case of out-of-court settlement of the dispute, the Consumer Ombudsman Service of the Federal Government is authorized to receive any request for out-of-court settlement of consumer disputes.
